The Court of Appeal in Abuja, on Wednesday, reserved judgement on the appeal filed by Governor Abdullahi Sule of Nasarawa State challenging the nullification of his election by the Governorship Election Petitions Tribunal.

The News Agency of Nigeria (NAN) reports that the tribunal had in a split 2-1 judgement on 2 October, declared David Ombugadu of the Peoples Democratic Party (PDP) winner of the 18 March governorship election.

Mr Sule had won the poll on the ticket of the All Progressive Congress (APC).

At the hearing of the matter in Abuja, parties argued their grounds before the three-member panel led by Onyemenam Uchechukwu.

The panel, thereafter, reserved the judgement and said that the date would be communicated to the parties as soon as the verdict is set to be delivered.

The court also reserved judgment on the cross-appeal filed by the PDP candidate challenging the dissenting judgment of the tribunal.

Earlier, Woke Olanikpekun, counsel to Governor Sule, adopted his five grounds of appeal and called on the court to set aside the judgment of the tribunal and uphold the dissenting judgment.

On his part, Kanu Agabi, counsel to Mr Ombugadu, adopted his brief of argument and urged the court to dismiss the appeal by the governor and uphold the judgment of the tribunal.

Even when you know that this man didn't win the election, as it was crystal clear that PDP won that election?? Senatordave1, garfield1, etc, all your law case analyses are always in favor of APC; so it is not actually a case of knowledge of the law, but using using and twisting your knowledge of the law to do propaganda for APC. That's shameful, to say the least.

Firstly,all analysis shows that he won actually.is this not this guy that sule trashed in 2019?
Not all my analysis are in favour of apc sir.again law is beyond who won.you must follow certain processes and if you fail to abide by them,you lose your case and ombugadu has unfortunately entered

Whilst I am still confident that Kano should be upturned, the SC judgement in Atiku & Obi v. Tinubu might have changed the perspective.

NASARAWA STATE GOVERNORSHIP ELECTION APPEAL
Today Wednesday 15th November 2023.
The court proceedings began.
The case began with the submission of Application by the lead Counsel of the Appellant(A A Sule) Chief Wole Olanipekun (SAN)
Prior to that,the First/ second Respondent (Emmanuel David Ombugadu) and PDP Counsel CHIEF DR KANU GODWIN AGABI (SAN)called on the attention of the Appellant that he has tendered a motion on the 8th of November and chief Olanipekun raised an observation that they also file another motion on the 10th of November.
The chairman of the appeal panel ordered the respondent to read out the motion which the lead Counsel to the respondent stated it in his motion that,he is moving a motion for the panel to strike out the Appeal filed by the Appellant.And he stated that the motion is Also attached with the Written Address,and the counter Affidavits on the 13th November.He Also appeal to the panel to kindly grant his Appeal as it is worthy of merit.
The chairman of the panel stated that the motion and the counter motion is here by adjourned to the final Judgement.
The Appellant lead Counsel counsel tendered five different process list of Argument.
The Respondent lead Counsel also tendered three process of Counter Argument as to the one tendered by the Appellants.
However,the third, Respondent (INEC)and fourth Respondent (APC) did not file any list of process of Argument.
The Appellant,Were given 5 minutes to present their case on why should his Appeal be accepted and he stated that the Tribunal never followed due processes of addressing the matter at the lower court.And appealed that the Judgement of the Tribunal be set aside.
Also, another 5 minutes were given to the Respondents to present their case as to why the court should dismissed the Appeal filed by the Appellant.
Chief Agabi (SAN) stated as thus, that the polling units results of the elections were the basis for winning and losing elections and the tribunal extracted her judgement strictly on that basis.Also, he stated that the BVAS Machines gave a clear record that Emmanuel David Ombugadu of PDP has won and Tribunal affirm that and that record were never challenged by even the Appellants.We Urge you most respectfully my Lord to dismissed their Appeal and regard it as a struggle to impeach the truth.
NOW THE CROSS APPEAL.
Now the Lead counsel to the cross Appellant ( PDP and David Emmanuel Ombugadu) Chief Kanu Godwin Agabi
(SAN) He tendered the cross Appeal scheduled of documents and the cross Respondents both appealed to the court to kindly strike it out.
However,the court accepted and admitted the cross Appeal and stated that it's reserved for Judgement.
In response to the cross Appeal,the cross Respondents couldn't provides a substantial response to their defence rather they only duplicate what was contained in their previous Appeal that observations brought by chief Agabi.
After all,The chairman Justice Mrs Onyenyema Ugovhukwu has Adjourned the case to Judgement in a date to be communicated.

Governor Sule's Grounds Of Appeal Just On Technicalities

According to Babajide Kolade-Otitoju of TVC, “it is not the work of the Judges to proof your petition or defence”. In the case of Nasarawa State, David Ombugadu of the People's Democratic Party(PDP) at the Governorship Election Petition Tribunal(GEPT) provided polling unit by polling unit results of the areas he was shortchanged in the 2023 gubernatorial election. On the other hand, the All Progressives Congress(APC) and the Independent National Electoral Commission(INEC) could not provide different results to proof the declaration that returned Governor Abdullahi Sule.

The court is not a father Christmas, as such, the Tribunal has to look the way of substantive evidence. It was also noted by a senior Advocate, Mr John Matthew, that the wrong computation could have been avoided if the electoral umpire, INEC did their job well. With all the opportunities INEC and APC had during the sittings of the Tribunal, they failed to provide any witness or any documentary fact as to how they came out with the over sixty thousand votes that gave APC victory and returned Governor Sule elected.

With the only evidences provided by PDP's Ombugadu, the Tribunal just recomputed the results and declared that he got the majority of valid votes. The grounds of Appeal of Governor Sule, APC and INEC are just on technicalities but not the substance or merit of the petition or defence.
