Due to the network failure experienced yesterday by subscribers of MTN Nigeria Communications, a Nigerian businessman through his legal representatives has written a demand letter threatening to sue the telecommunication gaint if they fail to pay a compensation of N10m he suffered over substantial disruption of his business activities and loss of huge business transactions and values worth millions of dollars. Failure to make compensation within 7 working days of which, a suit would be filed against MTN.


Here's a copy of the letter as contained;

Attention: Legal Department,
MTN Nigeria Communications

Dear Sir/Madam,

RE: DEMAND FOR COMPENSATION DUE TO BUSINESS DAMAGES CAUSED BY NETWORK OUTAGE.

The above subject matter refers.

We represent Mr. Charles Emordi, a valued customer of MTN Nigeria Communications, writing on his behalf to formally request compensation for damages incurred as a result of the network outage that occurred on 28th February 2024. The outage was attributed to significant damage to your fibre cables, causing disruptions to Mr. Emordi's business operations and resulting in substantial financial losses.

The interruption in service directly impacted Mr. Emordi's ability to conduct business transactions, communicate with clients, and access critical online resources necessary for the operation of his business. As a result of the network outage, Mr. Emordi suffered general damages estimated at Ten Million Naira (₦10, 000,000), representing the financial losses, inconvenience, and disruption caused by the service disruption.

It is well established that telecommunication service providers owe a duty of care to their customers to maintain reliable and uninterrupted service. The failure to uphold this duty has resulted in tangible harm to Mr. Emordi's business, necessitating the demand for compensation to mitigate the adverse effects of the network outage.

In light of the above, we hereby demand that MTN Nigeria Communications compensate Mr. Charles Emordi in the amount of Ten Million Naira (₦10,000,000) as restitution for the damages suffered due to the network outage. This demand is made in good faith to address the losses incurred by our client and to ensure that he is adequately compensated for the disruption caused by the service failure.

We trust that MTN Nigeria Communications will promptly address this matter and provide a satisfactory response within seven (7) working days. Failure to do so may result in further legal action to protect our client's rights and seek appropriate remedies under the law.

Please acknowledge receipt of this letter and provide confirmation of your intentions regarding the requested compensation. We are open to discussing this matter further and finding an amicable resolution to avoid escalating the issue.

Thank you for your prompt attention to this matter. We look forward to a timely and favorable response.

Did he enter an agreement with MTN that the network must never go down? Or, did MTN order him not to have alternatives?

All these companies already cover themselves with TOS before you buy their useless sim pack which people have mindlessly agreed to without reading them.

Even if the networks carry gun and rob your of all your airtime,they will still somehow be covered in TOS you have never heard of.
