Im a senior lawyer. The matter is simple. Tell him to reach his lawyer with the pictures and his lawyer will advice him better.

He had a divorce and a lawyer represented him in court. Let him go back to the lawyer with the pictures.

This is not an issue you should bring to Nairaland for advice.

I believe he will get justice from the court for the custody as far as he has been paying the money.

I think I will agree with Ahniin on this...

I don't think a court case would work here as no judge would rule against a child staying with the mother except if the child is being abused physically and/or emotionally.

I'm your post, you mentioned that the child is always seen by the villagers wandering the streets when the mother is away, you can arrange with the mother's sister (the one you said ia not in support of her actions and has even advised her to allow the child be with the father) for you to come movw the child.

The good side of this is that it I'll not be seen as an offense in any law court since he's the father!

And by the way, is your friend really sure as in DNA sure that he is the child's father??
If No, he needs to before he consider this advice.

I don't understand pushing evidence to the judge phone that is funny your lawyer is supposed to present that in court.Let me educate you be ready for a long wait,Nigerian court frowns at divorce,unless to expedite action you can prove your ex wife is insane or she is promiscuous and you can proof that action affected the child.Bro if you can proof any of this....pack go stay village near your piking.Thank me later.

Allow the child with her mother... Play your role as a father... Court case no good for the child mental health.

When my ex-wife filed for divorce, I felt my life was over.. I tried to settle but no way.. I list the man in me as well.

How will I fight the woman I once enjoyed a good time with? She is the mother of my 2 kids... My late father fought for his foreign children but did not go well... The children return to him after 18years by themselves... This I recalled.

I did not drag the kids.. I pay for their upkeep, school fees.. They never understand... But now I have to move on.

Why not build yourself so that your children may be proud of you than using court case to Rob their joy?

Please my brother, it is not easy for me but wisdom is profitable... Try to forgive her, feel free... JUST FOR THE SAKE OF YOUR CHILD. Well, I think I am happier.

Funny how quick it is for you to show the child's state. Why are you not quick to show proof of how much exactly is sent monthly for the child's upkeep considering the current state of the economy. Courts usually rely on archaic provisions of the law therefore the amount being paid may not be in tandem with the current state of the economy. You cant expect a Five Star treatment when you are sending a One Star monthly stipend. Bring her on this platform let us hear her own side of the story first. We can't judge based on only your own story. Also you need to show us proof of the said STI just as you showed us proof of the child's condition.

u guys should be whining urself. U didn't even ask to know the reason why he left the marriage but u are here saying it like he was the reason why the marriage didn't work. He doesn't care about the child but he came to the village and as been staying with the child why he receives treatment, alright. U didn't blame the mother for whoring around and abandoning the child.

Also remember that the best person to care for the child is the mother except she is mentally incapacitated.

Paying for children support can be overwhelming but if you are all together, won't you take care of them? School fees, and medical bills.

It's like a thin like for you to win. Don't waste money on lawyers... Use it to clothes and feed your child

But the court asked him to be paying a certain amount of money monthly for the child's wellbeing which he has been doing.

But unfortunately the effect of the money has never been significant by looking at the physical appearance of the child.

He always sends relatives to check on the child of which several reports have reached him about how the boy is always been abandoned to be wandering about alone while the mother will be hanging out with friends.

What strucked him to his nerves was the recent report about the child been seriously sick and rumours that the mother now deals with several sexual partners while still breastfeeding the child....
He travelled from Abuja immediately to his hometown to retrieve the boy via court order but unfortunately the court denied him because the baby is believed to be too young at 1 year and 3 months old.

Now that the court had adjourned the case till 28th this month, he however decided to stay put in his hometown to treat the baby. The baby was taken to the hospital. the doctor took off his clothes and to our greatest suprise, the child's body looks so rough, rashes and boils all over her armpit down to his genital region.

Laboratory test was carried out and the report showed that the child have sexually transmitted infections. Fungi infection (,jock itch) and candidiasis.

All these evidences have been push to the judge phone and what we are afraid of, is the possibility of the judge cautioning her to take care of the child and allow her to continue taking the child's custody.
Can he take the child forcefully after having all these evidences against the mother?

taking a child from a breastfeeding mother is never ideal but if the safety of the child is in jeopardy, then no judge will refuse to take the child away from reckless mother.... the issue is that you need CONCRETE PROOF to show that the state of the child is a direct result of the mother's actions, and not that the child is just catching common sickness (like any other child would at such age)
This your first line before the .... Should have been forwarded to the judge, words are important and having resetting effect.

OP, your "cousin brother" is doing the right thing. Big props to him. The fact that he has been sending her money and keeping an eye on his son's wellbeing/welfare are indications that he's a present father and good man, as he has not abandoned his child despite their divorce. Kudos to him for taking him to the hospital for medical attention, including tests. Please don't listen to any ugly comment above telling him to "face his life" and simply abandon the child. I hope he's able to get custody. God bless him.



How is he monitoring what she does to her body? He did the right thing taking him to the hospital to get him checked out and have tests carried out on him, which revealed he has sexually transmitted infections. Is that not something he should be concerned about? Your telling him to abandon the child is really the height of wickedness.



Fungal infections are not sexually transmitted.

Who didn't have some kind of skin infections when they were young? The boy probably has sensitive skin and the mother is probably using some harsh soaps and creams on him.

I really don't think the child will any better odd with the father, that's if the father doesn't involve a female third party in raising him.

We should have our own laws in this 21st century that suits our own climes and not that of the Western countries!!!
Those guys are way civilised than us. In countries like the USA, I can understand why babies are to be left with their mothers.
In Nigeria, it has been proven time and again that poorer single mothers are an untold danger to their babies!!! Nigerian courts that have no law for paternity fraud will not do anything if that woman kills her baby by carelessness!!!
If a woman can abort her babies without blinking, then be rest assured she can abandon her children to the unknown just to satisfy her sexual wants!
The reason most Nigerian women are this stupid is because the law seems to favour them unconditionally.
OP, fight for your child like you'd fight for your life! If you cannot protect your child now no matter the circumstances then that baby won't forgive you spiritually!
Make everyone standing in your way understand that you're ready to take laws into your hands should anything happen to your child.(Except you were at fault and nature is punishing you). Fight for your baby so that your babies unborn will scramble to come meet you effortlessly!
Besides, Nigeria should create a law that forces both parents to cohabit and nurture their babies until a certain age. By the time they suffer and sacrifice their freedom for this, a whole lot will think before venturing into it or leaving. This current arrangement of being with the mother while the father and mother are separated isn't working!

Why did you have to present the result to the judge?
You should have kept the result and on the next court date plead for a test at the courts discretion then marry the result with your own and present, cash finito but sending to the judge could jeopardise your chances especially if she has a good lawyer

What STD does that child have?
You can easily manipulate that village Doctor to write rubbish report for you but don’t think some of us are not smart enough to see through the yeye game you’re trying to play. Even the Judge will call that Doctor to come forth as a witness.

The child simply has nappy rash and most times, they are Fungal in nature. So it’s not out of place to say he has a fungal infection. Your child looks nothing like a malnourished baby by the way.

Do the right thing and provide a befitting housing for your child and allow his mother care for him till he’s old enough to have the custody reviewed. Abe you want to up root him from his mother and hand him over to your relatives to raise in her stead?

I do not expect your people to give you any good report about your ex wife anyways

The battle you want to start fighting will not end well if you continue like that

Go back and read my comment, if you still cannot get the point, then something is definitely wrong with you. Why is he monitoring his ex wife and her relationship(s)? His child's mother is fairing badly, he refuses to help, yet all he does is send people to monitor her and give reports. Does he expect those people to bring back good reports? He will also remarry or date, and I am very sure when he remarries, the child's fate will be worse off in the hands of a step mother. He can always attend to the child's medical care, while the child remains with the mother.

Agreed. That child will only be safe as long as the father raises him by himself. But it's highly unlikely. He'll just outsource his care.

Which everway, it shows carelessness from the parent and that parent is not fit to take care of a child. Mind you the child is just 15 months old.

STI is a broad term.
What STI does this child have?

Forget about that man.
He’s looking for anything to hold unto to convince a law court give him custody of that child. A child he’ll still hand over to his relatives to use for child labor.

The least the court will do is order further medical examination and investigations on the baby because these allegations aren’t minor.
