Femi Falana (SAN) maintains his stance that the members of the Rivers State House of Assembly who defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) have forfeited their positions in the legislative body. Around 25 lawmakers, who were loyal to the former governor of Rivers State and the current Minister of the FCT Nyesom Wike, had joined the APC amidst the political deadlock involving Wike and Governor Siminalayi Fubara. Falana, a human rights lawyer, had previously stated that these lawmakers would lose their seats for switching parties, and he continues to assert this position. He cited a Supreme Court ruling that emphasizes that one cannot defect and still remain a member of a legislative house in Nigeria, unless there is a division within the party. Falana also highlighted the absence of such a division within the PDP. A new crisis emerged in the Rivers State Assembly when some lawmakers elected Victor Oko-Jumbo as the speaker, with Oko-Jumbo being supported by lawmakers loyal to Governor Fubara. However, Falana argued that a quorum is required for the election of a speaker, as stated in the Constitution. He further emphasized that a two-thirds majority of the legislature is necessary for the removal of a governor through impeachment.

Rivers state reps... gone! Rivers local government chairmen .. gone! Wike’s puppet commissioners .. gone! Wike seeing he has no back .. ran to explain and apologize for wetin we no know Tinubu said.. he’s not taking side in Rivers matter.. Wike obviously is a goner.. hope efcc will do a very clean job on him Fubara is completely in charge of Rivers state Fact! Wike’s been playing eye service to BAT. He tries to show that he has absolute power and control in Rivers state. Unfortunately that was not BAT’s method in Lagos. There has always been a GAC where all the stakeholders meet and agree along with the suggestion of Tinubu, until now that he has become the President. Hopefully Wike will learn some lessons in politics and power in Rivers state with the recent developments. Quoting the late Chuba Okadigbo, Wike did not properly read the political barometer, neither did he do the proper political arithmetic in the state. Once he loses grip, he’s out of the cabinet. |

Falana is just emotional, he is not the judge....lt doesn't work that way. It has to go through a trial and A judge has to make that pronouncement declaring those sests vacant where the 27 Lawmakers are a party to the suit , the old case Falana was reffering to in supreme court can only serve as a reference and not binding on 27 lawmakers of rivers who where not or nevrr a party in the suit..... Let's wait and see how events unfolds All l know is that Tinubu APC will not watch fubara and co to go away with this Fubara will know who Tinubu is made off....let's enjoy the show.... It was an eyesore to watch that video where a local govt chairman in Rivers State held a microphone and openly insulted the state governor calling him a fool. That was a deciding moment for me. What an effrontery. Fubara needs to deal with him and his lot. From Wike to the least member in that gang. Could not help laughing when I saw them the other day under the sun in a solidarity March. So they all could be so humbled? Dem never start. They will still march under the rain |
