Wole Soyinka Urges Court To Nullify The 1999 Constitution by mukina2: 9:23am On Feb 10, 2012
Nobel laureate, Professor Wole Soyinka, and elder statesman, Mr. Fred Agbeyegbe, have urged a Federal High Court in Lagos to nullify the 1999 Constitution of the the Federal Republic of Nigeria. 

Soyinka and Agbeyegbe, in their submissions, argued that  the 1999 Constitution is a fraudulent document the military imposed on Nigerians, contending that the document lacked authenticity and could not be properly described as the people’s constitution.

They prayed the court for an order of mandamus compelling the Federal Government (the defendant) to replace the constitution with “a true constitution.”

Both Soyinka and Agbeyegbe are the surviving plaintiffs in the suit which originally had the late nonagenarian, Prince Tanimose Bankole-Oki (SAN) as the first plaintiff.

Bankole-Oki was however replaced by Agbeyegbe with the permission of the court after he died last year.

The other plaintiff in the matter, apart from Soyinka and Agbeyegbe, was the late Chief Odumegwu Ojukwu.

The presiding judge, Justice James Tsoho, struck out the name of Ojukwu from the case following an oral application made the plaintiffs’ lawyer, Mr. Tony Nnadi.

Nnadi said he would find out from the surviving plaintiffs whether or not another person would be approved to replace Ojukwu. Nnadi’s application was not objected to by lawyer to the Federal Government, Mr. Ituah Eigbe.  The judge thereafter struck out Ojukwu’s name and adjourned the matter

That constitution is a joke and those operating on it are all jokers if they think we can make any progress with that faulty document.

The day that phucking constitution is kicked into the trash can will be Nigerias true Independence Day.

All Nigerian's are slaves to a document that was designed to keep the country in the perpetual grip of ex-generals, but the vast majority remain ignorant and prefer to fight themselves foolishly.

Throw away the current constitution and give us true federalism. Let each citizen, state, culture and region be truly represented; let Nigeria become a land where each and everyone has a sense of belonging, not as it currently is where the citizen is merely an observer on a piece of land stolen from his forbears. Let Nigeria become "OUR NIGERIA."

I am sick and tired of going around in circles because the operating manual of the country is an operating manual for chaos. We need to do away with the constitution and give ourselves one that provides an abiding philosophy of what being a Nigerian entails; something that the man on the street can key into and feel motivation, belonging and hope.
We require a philosophical document such as the founding fathers of America gave their country, a philosophy that makes the American flag a thing of immense pride to the American and see's the smallest in society dreaming the big dreams that have produced Microsoft, Yahoo, Google, Facebook, the Internet itself etc. We need a similar philosophical grounding to weld us into one, in dreams, hopes and aspiration; something that can make the nation act as a unit to develop relentlessly to create wealth, satisfaction and fulfilment.

I am with Wole Soyinka.

This is what I've been expecting state government and local governments should be doing - challenging the Constitutionality of government power court not asking for more money. IMO, good move although I wouldn't say annul everything for now, MOST parts of the Constitution NEEDS thorough amendments, the flaws in the Constitution is what needs to be annulled. As for me, I'd say thrash everything, let Congress go into "starting ALL OVER AGAIN", this time the people's voice should be involved.

It would be helpful if people like Soyinka could tell us what exactly are the provisions in the constitution that they have issues with. Simply saying 'nullify the constitution' is not good enough and will produce no results.

Well, I used to feel same way about Gani, when he died, i began to miss him. we must just understand that these guys aren't perfect despite what most people hold them to be. And to an extent, i agree with him. the 1999 constitution is technically "not constitutional" because it was not drafted by a people's government. Any constitution must be drafted by an assembly of ALL the people's representatives.
Plus, this is just a strategy of forcing an SNC.

I would not compare Gani with Soyinka. Soyinka has mostly seemed to me a man who speaks when he is on the hurt side of issues. I mean the man's cries seem to change from year to year. And I don't think I will ever forget that this same was the man who was spokesman, for a time, for MEND.

Gani was a lawyer who went to the court on behalf of the people, and Nigeria as a whole.  Soyinka, I may be wrong, seems more concerned about issues that pertain mostly to sects and groups, not Nigeria the country as a whole, in much of his ideas.

There is nothing absolutely nothing wrong with the way the constitution came to be. If we were to follow you claim that the Nigerian constitution was technically not drafted by the people's government, then what do we say of the American constitution, which was drafted by a couple of men, majority of them never really served in any government then and afterwards?
Please we need to stop playing around with the moronic and focus on that which should matter.

Honestly, if this man is all out of good ideas, he needs to stop!

So because the US constitution was drafted by a handful of cultists, Nigeria should do the same. Something tells me Wole Soyinka isn't the one out of ideas here.

Many are hostage to the idea that " if oyinbo do am e must correct" and knoweth not that they are hostage. For accuracy though this court case is at the instance of Wole Soyinka and Others not just the man alone. Incidentally one of those "others" is the now late Odumegwu Ojukwu and the case has been on for a while.

what would u say of a constution that would grants a bomber/bokoharamist bail after eating jeloff rice for some weeks/months.

What would you say for a constitution that dances with ppl that steal trillions of naira while jailing somebody dt stole goat.etc

I don't think you are correct. the only issue i think he has reacted to based on personal feelings is Bola Ige's case. As for the MEND, he wasn't a spokesman for them o. it was a time where MEND felt they needed someone who had integrity and was not bought and paid for by the FG that they got the man. REmember when Lagos Jetty was bombed and all 'em southwest were issuing empty warnings left and right, Twas Kongi who reasoned (quite correctly too) that the attack was on NIgeria and not the Yoruba NAtion.

While I think Wole Soyinka is right, and whatever was drafted by those thieving Ex-Generals should be trashed, I can only cringe at what this current group of thieves will draft as "Constitution". Probably rob you blind to death if their antecedents are anything to go by.

While the 1999 constitution is rife with flaws, I strongly believe the prime issues that must be addressed, is the will of the sitting government to enforce the provisions of whatever constitution we may have as well as the independence and ability of the courts to deliver timely justice without bias to individuality or ethnic backgrounds. Without all these, we are nothing but a hopeless group of people whose constitution will forever remain elusive to the rich and powerful.

yes there is nothing wrong with the way the constitution came to be and that really should dnot be the issue, the fact that the constitution is not built around tru federalism is a main problem here.

The fact that Nigerians still defer to this fraudulent constitution says a lot about the people in that country.
Prof Soyinka remains one of the few sane folks in Nigeria. A strong person from the East should replace the Ikemba (may God bless his soul) and push this suit to a logical end.

Again, Soyinka made himself spokesperson on behalf of MEND. Cut around it whichever way you want, the fact is he decided to speak on their behalf, and history has that down on him. He essentially helped open the way for MEND to get the package( free trips abroad, free pocket money each year, free school abroad etc.) the group currently have.
