to those telling alhaji to return the car and get his money, didnt u read d condition the seller is giving? he should return the car the way it was and wait when the car is sold, that means alhaji will have to spend to fix the car by almost changing the engine, so y return it after spending so much to put the car in order?

The seller is not truthful, for those blaming the driver, he said about 7 lights abnormally On and alhaji told him those are minor things dat can be fixed, dat myt as well be why he ignored or did not take serious the thermometer indicator cause d dashbord lyts are abnormal.

Lesson: Never trust no body even ur mother! i av intention of buying a car from NL but i think i will change my plan, its not the same sweet mouth they use to sell that they will use for u when kasala burst.

Sorry but I don't think this is necessary at this point. The seller has been not been MISSING IN ACTION concerning this issue; also admittedly the seller bought the car without inspection at his own risk. You words are fanning the flame and not progressive. Everyone doing business has lost some money at one point or another whether out of ignorance or being taken advantage off. If you don't have any comments to help the parties involved resolve this issue amicably then don't say anything at all.

Whether anyone admits it or not - the seller sold a bad car and got a good price - there is no steal if the car was bound to have problems sooner than later. This is what happens pretty much in FESTAC (especially FESTAC) you get a surprisingly good price for a seemingly good car (It is called a Setup Car) you pay for it and quickly run home only to have it back for major repairs 3 weeks later grin A lot of crooked (pretending to be honest and never admitting that they had planned this Setup sale all along) Car dealers abound on Nairaland. very few exceptional ones who are honest - just a sad affair really. Trust is not a virtue anymore

The only way it can be settled since the seller claims the car was in perfect condition (but later admitted that several fixes needed to be done after collecting payment). He has basically misinformed the buyer. Which many posters refuse to admit. He should pay the full amount no matter what the condition the car is in. what if due to the so called unmentioned perfect conditions caused a fatal accident, it would have been another matter now. we won't be side-stepping the dishonesty factor like we are all doing here

@ OP, am sorry to say this but you showed a bit of foolishness to have partly or fully payed for a nigerian used car without a physical inspection not to talk of testing it. If i am paying that much for a nigerian used car, i will test -drive it from Lagos to Ibadan (to and fro!). Nigerians are corrupt and you can never trust anyone. The seller is obviously a crook. He knows the faults of this car and that is the reason he sold it cheap. My advice is that you should spend enough to keep the car in a good condition. You have already been duped; that is the truth. Take heart..

Well alot has been said here especially from the two parties involved. I see betrayal on the path of the buyer and then a seller trying to redeem his mage. It is not bad trying to trust people, at least give them the benefit of doubt. I too bought a mercedes benz 190 on nairaland. Though it gave me some challenges, God has helped me since I LOVE THE CAR. Been to 'Maiduguri' with it from Ile Ife.

But my candid advice goes to the seller (Damola), if you really want to redeem your image. DO NOT WAIT FOR YOUR CAR. REFUND THE BUYER IN FULL. Then show prove of repayment (either bank teller or otherwise). This will show you are honest and you never can tell, people might just start doing business with you.

Mallam there is no need to keep on drying all Demola's cloth outside,mind u u cant judge a book by it cover!Demolo was wrong and u were also wrong bt i guess DEMOLA shou av more of d blame!But we all know dat it wil b very wrong 4 us to refer him as a fraudster cus He has nt gone hiding bt stil communicating!Am also a mechanical engineer by profession!Mallam it might also cost u fortune 2 install any new engine,harneses(wiring) is also a major problem.Hw i wish u can get a diagnostic machine as used in Peageot automobile to detect all faults.(2m no b moi-moi)

Well, generally the rule is BUYER BEWARE anytime you are making a purchase like this one. In any case, it is all done now and both of you would have to come to a compromise position, as fairly as possible as both of you made errors.

I like the posture the seller has taken as he is not trying to deny everything and run away from the issues, which is good. I also do not believe he is still insisting you return it in the exact condition, as that is impossible for you then would have to undo all the work previously done. I would suggest you take him up on the offer to return it, get your refund and chalk the entire situation up to experience.

On a general note, I am quite impressed with the conversation here and this is similar to what Paypal & Ebay does when there is a dispute on transactions over here. Online transactions are built on trust and I hope Nigeria can someday also have the sort of freedom of abundant choices we have over here.

Nairaland is full of honey-tongued scam artists! The moderators and the owner does relatively little to put these thieves in check! I bet you Damola1 will be back next week (probably with a new screen name) to sell another "perfect condition" car to an unsuspecting Nairalander!

@ OP - your mistake was trusting a seller to sell you a car without actually inspecting it! You're lucky the seller didn't close his GT account and disappear into thin air leaving you with neither a car nor your N2mm! Happens all the time in Lagos!

I will really expect to read comments from Sienna, Inspired, Fhemmy, Emperoh, Banix etc. A couple of time, we have had people doubt dealers' sincerity on this forum and they are always up in defense of their action.

I do not agree to Demola's terms at all. Why should I give you 2 weeks to refund after you fraudulently sold a car that isn't road worthy to me? Alhaji, just go ahead and replace the engine or gasket and count your losses. The only way to salvage a situation like this is to minimize your losses.

If you have anyway to blacklist Demola from doing business in your organization, please go ahead. People are abusing a lot of privileges and trusts. November last year, I paid a friend (a teacher) some money to assist me collect my certificate from my University, he squandered it and told me lots of stories why he didn't . I immediately requested for a refund to no avail last month, I did a petition to his school and copied the Secondary Education Board for the Principal and Dirctor to assist in getting my money from him. Almost immediately, at the verge of sumbitting the letter, all manner of people, delegations etc. Started begging that I should forgive him, the money is not much etc. That's the society we find ourselves. I advise you to take action immediately.

You don't even know maybe damola is reading all this comments via another user id and re-strategizing himself for the next victim. Buying and selling can never stop via the internet so my my advice to people is that.

1. Don't trust anyone but learn to give someone a benefit of the doubt
2. Check out the date the seller opened account with NL and his/her recent activities
3. Don't make upfront payment for anything you want to buy on NL

You can add more to it

Buyer made a mistake in allowing those roadside mechanic handle the car. They are nothing but a bunch of quacks.

Seller did not give full disclosure. The car was involved in an accident and repaired afterwards. Seller should have disclosed this fact.

Buyer shd tow the car back to Lagos and both of them shd contribute 50:50 to the repairs.

Lesson: When you are selling anything always disclose full facts otherwise it can be assumed that you wanted to deceive. When you are buying go about it as if the seller is out to swindle you.

Interestingly, Inspired_m, (the auto section moderator and a renowned dealer on this forum) sanctioned this transaction at some point, claiming to know everything about the car. I find it curious he has not contributed since this transaction got messy.

Damola took advantage of the distance, Dont blame the picker he was just a mere delivery boy. How can he buy N2,000.000 worth of problems you all put yourself in the buyers shoes.He only dealt with the guy based on trust thats a very bad thing well lessons are being learnt and we all have learnt one. The seller saw all of this coming, Am glad he did not put up a fight and his willing to refund. Seller please do refund like you promised

I will advise u to return d car, after fixing. any car with chasis wahala, d tires will in most cases never b align again. if not, b ready for alignment and buying of new tires frequently. i am talking from exp. and dat of others. Sallam

The Internet is a market place, like any other market place, you have to becareful with who you are dealing with, It is not too difficult to check a car, if you cannot pay someone to do the same for you, do not generalise based on your experience, there are good people here on Nairaland as there are bad ones, it is like that anywhere you go, Nairaland or Car Dealer in the US.

I am a Lawyer, this is an interesting case devoid of uberimae fidei, inter alia. OP, can file a suit for status quo ante or nay liquidated damages provided that he can prove that the car was faulty before purchase, that's the onus upon him. He who alleges must prove. Albeit, it is for the court to decide, business eficacy and officious by stander. Was there a warrantee or guarantee? Let me not enlarge upon the mark ipso facto lest i ignite the quest for justice. Whilst reading this thread vide supra i noticed a term "counter offer" ergo @lekky you can sue. Feel free to consult and seek my legal advice. Ubi jus ibi remedium.

@Alhaji, just fix the car and leave everything to God. In my own opinion, u don't need to buy another engine may u buy the top cylinder alone (half engine), it should work well after that.
@Damola, enjoy ur money cos maga don pay. But sincerely I doubt if some people ve conscience.
@all, I am in a deep shit like this one too for trusting somebody (Nimbouregistry) on nairaland. He said he is into company incorporation and it will cost me #44,000 to register a limited liability company and also design and host the company website out of which I ve paid #39,000 (just a balance of #5,000 left which is expected to be for courier delivery of my certificate and document to my base). According to him, he said it will take him a maximum of four weeks to get everything done but it's over two months now. The funniest thing is, he sent me a text yesternight that I should borrow him #10,000 cos he is in a financial mess and that is why my certificate is delayed. Pls, has anyone had any business deal with this guy(Nimbouregistry)? He is based in Abuja, I created a topic to ascertain the authenticity of this guy and his company but the moderator decided to hide it.

ALL NL CAR DEALERS HAVE SUDDENLY GONE MUTE..TOO BAD BUNCH OF THIEVES. from what i have been reading from both op and seller.It an insult for damola to tell alhaji to return the car as he sold it to him then he can have his refund.The truth be told , this is a calculated scam.damola scammed you alhaji if damola was very honest he would accept the car as it is and pay the refund asap but i know it wont happen.My advise is alhaji should repair the car and love-vendor the car up and leave damola to his conscience.and please can alhaji post the pics of damola so we dont do businness with him again or better still NOBODY should buy cars from NL again so we dont have this kind of complaints cos its very painful reading this kind of B.S.

I am so sorry for your loss. I have this policy, Even though I am not a billionaire today, anything i need to buy, I buy from oversea and tell the seller to ship to nigeria. If they tell you it is yellow, you meet yellow there but if you buy from nigerians, they tell you it is yellow, i am very sure you are under yellow light. I dont know why we dont want to say the truth in matters... Their belief is that once done it is finished and God will forgive us if we ask for forgiveness... but remember you are laying tares for your children... and you will also pay hard.

Guy, take heart, dont contact him again and he will be surprised when the money you paid him will be given voice to speak against him on the day of Judgement.
