True for the invalidity of APC votes.

But the electoral law says the winner must have a simple majority as well as have a 25% of total votes cast in 2/3rds of the LGA.

The problem is that APC's invalid votes count in the total votes cast. This is what INEC will analyze in their meeting.

Zamfara has 13 LGAs and 2/3rds is 9 LGAs. So PDP must have wont 25% of the total votes cast in 9 LGAs to qualify as a win, else a rerun must be done.

For example for an LG
APC 100k
PDP 20k
Other parties 5k
Invalid 1k
Total votes cast 126k

With the judgement

PDP 20k
Other parties 5k
Invalid 101k
Total votes cast 126k
Now the PDP must win 25% so 20/126=15.87%

At 15%, PDP didn't win. If up to 5 LGA has result like this, a rerun will be held without APC.

The problem if PDP doesn't scale through, there will be no governor on May 29th which is 4 days away. There is no Governor, no deputy, no speaker which are the line of succession. INEC cannot conduct a rerun in time and there cant be a vacuum in that office, the result is a Lacuna.

Does the constitution recognize wasted vote.the supreme is actually compounding a serious debate. Wasted votes automatically disenfranchised the voter who had nothing to do with internal issue of a party. The best the supreme court should have done is other a new election with APC excluded. People votes must count not court vote. Supreme court erred in error.

The Supreme Court is not compounding any debate. Ab initio, INEC refused to recognize Zamfara State APC candidates, which they communicated in writing. APC went and procurred a kangaroo high court order compelling INEC to list them. Although another high court gave a contradicting order, INEC choose to obey the one in favour of APC. After election, Appeal court voided their candidatures which had now been endorsed by Supreme Court.

The blame should be laid squarely on the door post of APC who knew the position of the electoral law and chose to disregard it. This end was predictable right from the beginning.

Supreme Court holds that all votes casted for APC are wasted votes and not invalid votes. So, let us how INEC will interpret the wasted votes and "the requisite spread" for the second highest political party with valid votes.

In electoral law, there is nothing like wasted votes. The legal term is invalid or rejected votes.

i thought we will never have to do these again until another 4yrs, obviously the pdp sympathisers yet to learn a thing,
first of all! the court never mention or declare pdp as winner, the judgement only compelled inec to declare 2nd runner up as winner provided the party meet the requisite.
the fact that some vote are rejected or voided does not affect total vote ,check inec spreadsheet of all elections total vote will alway be the sum of valid votes + rejected vote racoon said you are intelligient i laugh ... that's an expensive joke on NL.

Based on the ruling , All APC vote cast are invalid, void and non existent ab initio. For governoship, It suffice to say that the total valid votes is now 810,782-534,541= 276, 241.

Therefore, the winner must meet the following;

1. The majority votes.
2. The contest having scored upto 25% in 2/3 no of local govts .

This could be verified by subtracting the void votes of the APC from each of the local govt council (for governoship)

Meanwhile, for all other positions like Senatorial seat, House of Reps and state house of Assembly shall be for the candidate having the highest votes.

The court first declared all votes allotted to the APC as wasted, rubbish and void. So subtract those and come back with the actual, judicially recognised votes and your question again.
You're olodo, was it the APC that voted or the people of Zamfara. The votes cast by people of Zamfara for APC cannot be cancelled from the main votes by your analogy, their votes still part of vote cast but does not benefit APC.
Think like someone that passed through school.

The essence of the constitutional requirement of 25 percent in 3/4 is for a great spread of the state indigenes to have a say in electing their governor.

And for anybody to imagine that the Suprme Court would seek to punish the over 70 percent of Zamfara indigenes who voted for the APC not out of breaking the law but simply because the APC fumbled their own primaries is quite idiotic to say the least.

There is no way that the votes cast for the APC could be disregarded in determining this "spread", required by the law.

No way!!

That would amount to technically disenfranchising over 70 percent of Zamfara indigenes who did nothing wrong.

The Supreme Court wouldn't contemplate that.

From your logic you are still saying APC should participate in the election.

One thing that is clear from Supreme Court Judgement is that it declared votes cast to APC in all the elections in Zamfara State in 2019 as *WASTED VOTES .*

By implications , all the votes cast to APC candidates assumed not to exist in the eyes of the law according Supreme Court .

Always know that, there is difference between moral thinking and law. As far as the Zamfara case is concerned, all votes allocated to APC does not count in anyway either as valid or invalid, it's wasted voted; null! So count the remaining parties valid votes and consider the invalid too.
