Very bad of them.i have a thread about this case.i deduced that since the results were inconclusive originally before the alleged forced declaration,inec could have quickly called for supplementary polls.or inec could disqualify okorocha as a candidate and declare apc the winner or inec can disqualify rochas and let apc field someone else for the supplementaries.this would have given inec a lot of advantage and leverage in court.
But unilaterally withholding the return certificate indefinitely is lawless and no court will accept this.

there were series of rigging and intimidation of voters too. Infacts the results was announced under duress .You never have conscience to tell us the truth cos' you have vowed not to tell Nigerians and nairalanders the truths. Besides the pdp senatorial candidate have approached the tribunal to seek redress on the sham election .

I had posited in the past that INEC will find it difficult to spin this one. It stands logic on the head that you announce a winner (declaration) and then claim "under duress". The the REC not know the meaning and context of "Declaration of winner" under the law? That INEC withheld Okorocha's Cert is even ridiculous. There is nowhere in the law that stipulates that INEC can "cease" a certificate of return.

If it was declared under duress then it is void and no one was declared winner. I don’t understand the judge.

Mr Okorocha’s old rival, Osita Izunaso, who ran under All Progressives Grand Alliances (APGA) is coming behind Mr Onyeriri in the results so far.

Results from three LGAs are being awaited for Imo west district.

The election was adjudged by observers and participants to be fraught with irregularities such as ballot snatching, invasion and harassment by thugs, especially in Mr Okorocha’s strongholds.

Despite his fallout with the Imo State chapter of the All Progressives’ Congress (APC), Mr Okorocha rode on the flag of the party to lead his close rivals in results so far.

Mr Izunaso, a former senator of Imo west, was in the APC with Mr Okorocha until the crisis currently rocking the ruling party, prompting him (Izunaso) and his allies to jump to APGA.

The judge has always been known to be useless. He takes direction from the presidency in his "judgments".

A Federal High Court in Abuja has ordered the Independent National Electoral Commission (INEC) to issue a certificate of return to former Imo State governor, Rochas Okorocha. Justice Okon Abang on Friday ruled that the having been declared by the Returning Officer as the winner of the February 23 senatorial election for Imo West Senatorial District (Orlu Zone), INEC has no reason not to issue him certificate of return.

Justice Abang overruled the submission by candidates of the PDP, Jones Onyeriri and APGA, Osita Izunaso that the matter ought to be taken to the election petitions tribunal since it has become a post-election matter which robbed the court of jurisdiction under sections 285, 251(1) of the 1999 Constitution. The judge held that petitions to the election tribunal under Section 133 of the Electoral Act should be made by the losers, and not the person declared winner whether under duress or not.

“The reliefs sought by the plaintiff (Okorocha) does not relate to the validity of the election to warrant him filing petitions at the election tribunal,” the judge said. “The tribunal has no jurisdiction to answer questions as to the validity of INEC’s action. Action of INEC not to issue certificate of return is unknown to the Constitution and the Electoral Act.”

Under the electoral law,inec has the discretionary powers to withhold certificates under extreme cases for just a short period and the courts also have the powers to order inec to issue out certs.i opened a thread on this once
