There are calls in some quarters for the Nigerian Army to kill Boko Haram terrorists who have surrendered.

The Nigerian Army has recorded massive success after they adopted a non-kinetic approach (a strategy which sees them accept insurgents who surrender) to tackle insurgency in the North East.

According to reports, over 3,000 Boko Haram and Islamic State West Africa Province (ISWAP) members have either been captured or surrendered to the military in the last three months.

However, contrary to calls to kill the repentant insurgents, the military insists that they will rather reintegrate them into the society than have their heads on a stake.

The decision of the military on the matter has elicited criticisms from many Nigerians who feel that one of the ways to pacify families of victims of insurgency is to execute them.

However, the position of the law on this matter is different.

According to the International Humanitarian Law (IHL), otherwise known as laws of armed conflict, which is the law that regulates the conduct of war, the Nigerian Army cannot kill or execute Boko Haram members who surrendered unconditionally.

The law protects persons who are not participating in hostilities by restricting the means and methods of warfare available to combatants.

In this case, since Boko Haram / ISWAP members have surrendered, the military is prohibited by international law to kill them.

Nigeria is signatory to the International Humanitarian Law, therefore, it will amount to war crime if the Nigerian Army goes ahead to execute these men who have chosen to abandon their cause and pursue peace.

Besides, if surrendered Boko Haram members are killed, other members in terrorist camps, who may be contemplating to surrender will decide against it and continue hostility.

Therefore, it is best that Nigerians call for restitution for families of victims, rather than seeking retribution and/or retaliation.

Nigerian government would also sought after laws that suit thier promiscuity...

They throw law to the bin once an issue like secession comes up cus it threatened their client otherwise known as Nigeria,whom they cashout steadily from as out wen due.

According to international acts on rules of engagement and treatment of captured or surrendered soldiers.
So you politically correct but when it comes to a bokoharams matter, I think our soldiers are following the rules too much!

What of gana that surrender in Benue state, did the military remember the code of engagement or what have you. Did the military remembered that they are signatory to the international nonsense agreement before they kill him.
This is pure double standard.
