I hope to get honest and open view about what to do in this situation.
So i lost my mom 2yrs ago, my mom had 5 children and am the third born of my mom. But I'm the first born of my dad reason being that my mom had married to a man at her early year and had two boys for the man before divosing and later got married to my dad.
Reason for the divorce was not something bad, but because the man my mom got married to earliar had three wives, and she had to leave because of rivary.
After she got married to my dad, he accepted to train the two boys. Now the first two boys are married, tho am not yet married am 28.

Now the issue is, my dad also died last year but unfortunatly he had no will and he had alot of properties. And because he had no will it very hard to share what he left and among who to share with.
I'm the first born of my dad and i think i should be one to decide how it goes, but my mom's first born is trying to play the role.
Pls what can i do because i dont want to fight him.

Am willing to but he is making it difficult because he want to be making all the dictation on what to do, and am not feeling comfortable...My dad have no relative to help decide on what to do

Who owns the properties?
If it is the father, then let those fathered by the father take charge. If by the mom, let all her children be involved.

Did your father formerly adopt those brothers of yours?

If not.... His properties are yours entirely.

You can share some TO your brothers as you deem fit out of brotherly love.

They will probably not share their father's property with you if they were in your shoes.

What surname do they bears
Your dad surname or their dad surname

If they bear their dad surnames, then they are not going to determine how thise properties will be shared

If they bear your dad surname
You are supposed to take a lion share of the properties be it in cash after the sales of the properties or the best of the property, located in a very good location

You need to let us know who's surname they bear

Does your kins men see them as their son or not

What kind of properties are you talking about

You can list them for proper advice

If you have females as siblings then indicate it

If you have another bother then indicate

Your mom should have a say in this matter, the properties should be shared between all of you, you having the largest share of all.

They are not heirs to your late father, you are your father's eldest son, you and your younger brothers come before them regarding anything pertaining to your late father.

So the thing is that my dad has a lawyer who is a family friend who has most of my dads property documents, but he is more closer to our eldest brother. What can i do about that?

He never knew he would die that soon after my moms death...just a year in between. I blame for not having a will. Maybe i should have talked to him about it when he was alive. But i didnt see it coming.

They are mature now, they could still be in good rapor with there fathers people, but they are also in good rapor with my dads.
I am alway my dads kin after my mom.

Don't allow your step brothers to come in and do the sharing, you are your father's first son, stand your ground. You should give them something no doubt, but it shouldn't be much. Call all your real siblings and speak with a lawyer if your step brothers try to cause problems.

The most important thing is find a way get those property documents from the lawyer first.

What are ur father's kinsmen saying about everything? If they are not aware of the current situation on ground.......u should inform them.

If u can't get the original documents from the lawyers.......then forge the documents......just know your dad signature.
