It means each candidate must have at least 25% win of total vote cast in each state of 36 states including FCT.

No, that's not what the law says. It says, in addition to having the highest total number of votes, the candidate must also have at least 25% of votes in at least 2/3 (two-third) of the 37 states of the federation (Abuja makes it 37).

That’s not what the constitution said. The FCT is not a STATE. It doesn’t not have any elected Governor but an appointed minister by the President.

We shall argue this issue to the last and forcefully resist your attempt to make the FCT a state.

It’s a federal province under the control of the federal Government.

Yes, I know, I just wanted it broken down so it can be understaood. The law does not say if the candidate doesn't get 25% in abuja, then he can't win.

now look, 2/3 of 37 is about 24.6, approx 25- So, if the person polls 25% or more in 24 states, and then fct, making it 25, the person has passed. If the person gets at least 25% in 25 states, without FCT, the person has also passed. So, there is no law that makes fct standalone on that 25% requirement, that's why I kukuma included fct as a state because in this case, they are all on the same league.

This is what sub-section 2 of Section 134 of the Constitution says. In this instance, FCT is technically classified as a State so irrespective of whether a candidate has two-thirds or not in FCT, he is deemed duly elected.

(2) A candidate for an election to the office of President shall be deemed to have been duly elected where, there being more than two candidates for the election-

(a) he has the highest number of votes cast at the election;

and

(b) he has not less than one-quarter of the votes cast at the election each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.

That was why I included fct as a 'pseudo' state. it means you must get at least 25% in at least 2/3 of all the states and fct' (fct here included as a state). It means if you get 25% in fct, then it counts as a state..

I do no think there will be any rerun of election, Section 299 says that FCT can be classified as a State. That is why you see a Senator & other Federal HoRs members being elected

25% spread in 24 states, including Abuja means Abuja is treated as a state on its own for election purposes, even though it isn't. Logically, if a candidate has 25% spread in 23 states and 25% in Abuja, he's okay. Or 25% spread in other 24 states, excluding Abuja, he's also fine.
