The Federal Competition and Consumer Protection Commission (FCCPC) has said that it will issue a summon to Erisco Foods Limited over the arrest and detention of Chioma Egodi Jnr.

The Executive Vice Chairman/CEO of FCCPC, Barrister Babatunde Irukera, made this known on X (formerly Twitter) following the arrest of Egodi, who made a review of Erisco’s product.

“UPDATE: @fccpcnigeria operatives have confirmed arrest & transfer of the case to Abuja by the Police Force. She was no longer at the station on arrival,” Irukera posted.

“Working to determine exact current location & engaging Force HQ in Abuja. Summons being issued to @EriscoFoodsLtd immediately.”

The lady in question, Egodi Jnr, made a post on Facebook on September 17, 2023, where she said she tasted too much sugar in the tin tomato she bought, a product of Erisco Foods.

“I went to buy tin tomatoes yesterday (September 16) that I will use to make stew; I didn’t see Gino and Sonia, so I decided to buy this one,” she wrote.

“When I opened it, I decided to taste it omo! Sugar is just too much! Haaa biko let me know if you have used this Tin tomato before because this is an ike gwuru situation!”

The management of Erisco Foods Limited thereafter issued an official statement about the post Egodi made on Facebook about their product and also said they would take all necessary actions against any malicious attack on their reputation.

“The attention of Erisco Foods Limited has been drawn to a Facebook post by one Chioma Egodi Jnr on September 17, 2023, alleging that Nagtko Tomato Mix, one of the three tomato paste variants of Erisco Foods Limited, contains an unhealthy amount of sugar and therefore not fit for human consumption,” Erisco wrote.

“While this claim is untrue and unfounded in its entirety, we wish to put on record that Erisco Foods Limited, from inception Is built on the vision and mission to manufacture and promote healthy, wholly Made-in-Nigeria tomato products with the commitment to feeding not only Nigerians but also Africans with healthy foods.

“Our Initial reaction was to ignore and disregard the post which was obviously intended to mistead our esteemed customers and discredit the image of Ensco Foods Limited, as previously instigated by some elements and syndicates who are uncomfortable with our increasing market dominance as a leading indigenous manufacturer of 100% natural tomato pastes. Considering, however, that Erisco Foods Limited has built a reputation as a credible organization committed to due process and the good of humanity, we have decided to bring the said publication to the attention of relevant authorities.

“In light of the above, we wish to reiterate that Erisco Foods Limited is solely committed to the production of healthy tomato products, including other products that have the full regulatory stamp and approval of NAFDAC and Standard Organization of Nigeria.

“While we recognize the rights of our consumers to make genuine observations about our products, we want to thank our esteemed customers for their continued patronage of Erisco Foods Limited. However, having built our reputation on healthy and quality products which have earned us both local and international awards, including the National Productivity Order of Merit Award, we will take all necessary actions against any malicious attack on our reputation.”

Egodi was arrested and whisked away to Abuja by the Police Force, as confirmed by the FCCPC boss, Irukera on X (formerly Twitter) on Monday.

“This has come to our attention @fccpcnigeria & we are engaged. Saw statement & deepening learning of the circumstances right now,” he posted.

“We have a team seeking to clarify arrest/detention status of the subject; & activating regulatory process to secure explanation from @EriscoFoodsLtd.”

She is not a defenseless lady. If you live in glass house, don't throw stone. Even in Nigeria, if you cant afford a lawyer, the State DPP provides you a lawyer. If Erisco legal team proved shes a flight risk, she might be remanded. The question is what did her legal team do? I am sure she was probably served or invited for questioning and probably ignored or try to evade, before she had to be picked up.
Her post is online, not in Lagos or wherever she resides. If Erisco HQ is based in Abuja and they filed in Abuja, she will be taken to the said Abuja.

You are only making all these statements based on social media sentiments.

She might have been unable to perfect her bail conditions, and hence remanded in custody. There is nobody holding her incommunicado. If she has been charged to court by the police, she will be availed the option to bail pending the case. If she cant meet bail conditions, she will be held in custody LIKE EVERY OTHER PERSON.

You can voice your opinion all you like, but you cannot destroy another person or business with your opinion and expect people to allow you a free pass.

Imagine if her opinion (or product review as you all call it) leads to boycott of Erisco products, and the company goes bankrupt because its unable to meet its financial obligations to staff, vendors, banks, investors etc

Erisco is exercising its full rights under a democratic system, which you dont seem to understand. She has a right to go on FB and spread unfounded information, and Erisco has a right to legally go after her claims since they know those claims are false.
If the product is sent to a Lab and a food tech scientist comes back with a report there is no sugar in the product, she has the onus to prove there is sugar in the product.
She also said the products have killed people; she has the onus to prove that there are indeed people (provide a list of names and dates) thats have been killed by the product.


The only dangerous path is people thinking social media is their beer parlor gathering and can say anything they want. She made a review filled with false information and claimed the product killed people. That is ALL the proof of malicious intent Erisco needs. Even if its a review she made (I wonder who sent her), she cant make a negative and damning review based on falsehood and say there was no malice.

Social media and or free speech or personal opinion CANNOT REPLACE going after people for LIBEL, when it has the potential to harm another or destroy a business entity.

There is no dictatorship in this matter. She beat the drum, she should tie wrapper and dance to the beats.

You still fail to realize thar this is a civil matter and not a criminal one. So where does the flight risk come in? All these things you are talking about, ie flight risk, bail, remand, etc are criminal cases. Libel is basically a civil offence which penalty is mostly fines and damages, and not actual jail time, unless there are other issues attached like contempt of court or failure to pay the fines.
In the US Fox news was asked to pay Dominion $700 million for defaming their electoral machines. No one went to Jail, not even Tucker Carlson. No one was detained, no one was questioned by police.

It seems you don't under stand how democracy works.

As far as I am concerned, that lady was only catching cruise. So, she never saw this coming. She obviously belongs to the "Come and beat me; I dey my house" crew. Now, she's getting what she deserves.

There are people who are obsessed with what they will post online every day just to stay relevant because they feed on clout chasing. It's okay if they chose to live that kind of lifestyle, but not at the detriment of another man's efforts, resources and time.
Sugar is part of the ingredients in tin tomato, it is when it's noticed through the taste bud that it's abnormal (excessive). Thanks

Actually you are wrong.

She didn't destroy the company image but seeking opinion of others on their product.

Remember, in 2007, a Baby teething product called MY PIKIN was released to the market by 2008 over 80 babies have died from it.

Public outcry brought government attention into it and it was discovered that it actually contain a certain substance that can cause harm to the body. Eventually, the product was banned.

So when is given negative feedback about products become a crime?

The company failed to have used this as opportunity to do good PR for their product rather than arresting her.

What if some crooks have already produced the counterfeit of their product?

What if there was actually production error somewhere?

You see negative feedback for a product isn't a crime.

Theres is a procedure to follow. Social media rants will just get you in trouble.

So many in western countries have gotten arrested for lesser crimes than this.

I am 100% with the Erisco Foods Ltd. As much as the Consumer can always be right,the Manufacturers should equally be protected from sponsored & careless malicious defamation of their products.Customers can complain but certainly not through the Social Media..What if the Product conforms with acceptable standard? That your taste board feels higher concentration of sugar doesn't mean others will feel same.

Oga there are better ways to handle this type of matter. If companies get all the power and protection, I bet you that even your government will work for them and you won't escape harmful products whenever they happen.

If she could prove that the tomatoes paste company didn’t exercise care towards her by releasing such product into the market, the company could be held liable.

This is very wrong of her, I always go for that product anytime I want to cook with tin tomatoes. I don't use another product since the very first time I tried, it so good. There is no truth in the woman's claim .

Furthermore, below is what the lady arrested said, and no where did I notice her making accusations against the company relevant to you suggesting if my schoolmate had said my elbow was dry because I probably do drugs.

This company chose the wrong battle to fight. How do they prove what she shared wasn't her experience with the product? She can make money off this case. This is just high handedness and intimidation using state apparatus. It's a shame the police force allow themselves to be wrongly used by people
