There shouldn't even be a middle ground, he's supposed to pay back the buyer the full sum cause he reneged on their arrangements and he's trying to bank on the fact that the buyer doesn't have substantial evidence to try and wriggle out of paying for his mistake. I paid him 70k and last week Saturday he called me that the phone is now in Nigeria and @omicpet will handle the waybill... I transferred the remaining balance of 300k... I now asked about the waybill bill... He said @omicpet company will handle that... I told him I'll like to know the actual price... So I can pay everything.. Then I went on to tell him I want home delivery.. Because I just moved to ibadan without knowing any place... And to also be on the safe side... He said Lagos to ibadan should be around 3k or 4k but maximum of 5k... I said OK... I sent him 4k... I was expecting home delivery... Then a man called me around 7pm yesterday.. The man said he was to deliver a package to me... I was really confused.. I called @bdemix just to confirm because I don't really understand... @bdemix said he was expecting the waybill number... OP should involve the police and other military men in getting to the root of the matter. You can also involve private investigators. It's almost as clear as day that either the seller, omcipet or the driver involved is trying to play smart or the three aforementioned parties ganged up to dupe you.

1. Why didn't the driver call you before leaving Lagos for Ibadan or why didn't Omcipet inform you that he's about to send the phone? I've had deals with macbeyland, giddieberry, jboix and some other dealers here and all of them inform me before sending packages down and even go to the point of following up to ensure I get my package safe and sound.

2. Why is bdemix not saying anything about the text messages you sent to him about address and delivery on 12/12/2020?

3. Something is not adding up with bdemix constant denial of the fact that you two initially agreed to sending it directly to you and not waybilling. I wish there was call recordings or more of your conversations..

Left to me, I'd say these guys are just trying to act smart about the whole thing. Maybe nothing was even sent or there was a connivance with the driver to stage a robbery and make it look like your package was stolen en route. You need to really take this up.

If you buy things in USA, and usps lost item, will you hold seller? There are always options there for the buyer to choose from.

In this case, seller should have done better by requesting to use a different shipping method no matter the extra cost. Seller should not have included omicpet fees to the 4k he was paid as that one was for the waybill only.

When I want to waybill something, I'll always tell buyers that I'll do it the next morning, where I'll relax and walk from park to park and company to company till the buyer chooses one. I'll give prices, method it will be waybilled with and wait for buyers choice before I drop the item, no matter how low the value is.

I suggest the seller should speak to both the shipper and the buyer and find a way to balance the buyer.

It doesn't matter how much the buyer did or did not pay for the waybill, he didn't receive the item so a refund is due to him. I would personally advice you take the matter to court if no settlement plan is reached, the contract was the delivery of goods and there was a breach. That way you have legal backing. Forget all those advising "bring police", "bring soldier", you don't know who they also know and you'll just end up spending your time and money.

I know it sounds heartless, but the fulfillment agent (which is the driver ) is ultimately liable for the loss. You aren't responsible for getting him to pay up, that's Omic's job. He has agreed to provide a service so he bears the total risk.

Harryfrosh, you don't have issues with Omic, yours is with the seller.

I think to limit your liability as a seller, please kindly state the risks involved in the type of courier service you choose to use. If the customer accepts it, fine.

I only made a payment of delivery to Ibadan, I was not inform when the item was sent to ibadan, the message I received when the delivery payment has been made to Omic was "I have wrapped the phone and it will be sent" I informed the buyer about that and I told him I was charged 3k that he should send me his acc number so that I could refund him the extra 1k but he insisted I should not bother to send it rather I should use it as my calling card.
