aceman88:A tot sef no fit misyearn like the apc is doing. Who owns the accounts into which narcotics proceeds were dumped? They harped on the forfeited proceeds and the respective bank accounts but talked less of the beneficiary and owner of same account numbers. But Why do we have such high number of criminals in Nigeria like this? If someone committed money laundering crime or deposited a lump sum into someone else's accounts, EFCC won't allow that person to rest. In fact after forfeiting the said money if the source can't be explained, the efcc would still be on the accused trail and jail him if they can lay their hands on him/her. See the same people who are supposed to uphold our constitution now denting it? Shame! Can any of them afford to forfeit ordinary 500usd of their hard-earned money? Its a question which any sane being should ask him/herself. If it's that easy to lose such huge sum without blinking an eye, then those living in America for decades but can't build a duplex in Nigeria should be swimming in money by now. APC further averred that whereas Obi joined the LP on May 27, he was subsequently declared the winner of the presidential primary election the LP held on May 30, 2022. “By section 77(3) of the Electoral Act, 2022, the 2nd Petitioner (LP) is mandated to have submitted its comprehensive register of members to the 1st Respondent 30 days before its presidential primary. “That is to say the said register of members must have been submitted to the 1st Respondent on or before 30th April, 2022. “The 1st Petitioner (Obi) as at 30th April, 2022 was still a member of the PDP and his name was not and could not have been in the register of members submitted by the 2nd Petitioner to 1st Respondent (INEC). “The Petition herein is incompetent as the 1st Petitioner is not a member of the 2nd Petitioner since the 1st Petitioner’s name is not, and could have been listed in the list of the register made available by the 2nd Petitioner to the 1st Respondent, same having been made available before the 1st Petitioner joined the 2nd Petitioner”. Not all forfeiture are related to crime. If they sell you a stolen car, if it's established that you know nothing about the stolen car you will only forfeit it. No criminal charges against you. Same applies to non payment of your mortgage or leases. You will forfeit the asset without criminal charges. That's what is called civil forfeiture. The one with crime is called criminal forfeiture. jaxxy: You are presenting your argument from both sides of the divide. For the #dasukigate "brotherhood", you said said they were guilty but not convicted, eventually reaching an out of court settlement. The court did not pronounce them guilty before most of the culprits, who you'd refer to as the defendants (Dasuki, Bafarawa, Dokpesi, Metuh etc) reached a plea bargain. A more appropriate analogy would have been the case of Doyin Okupe who was convicted with a 2-year sentence before settling for an option of fine. For Bola's case, problem is there is no evidence of a criminal conviction or a plea bargain. The forfeiture for the famous 460k is enveloped under a civil case, and not a criminal one 2 Likes |
