The covenant before the law was ratified by blood. The covenant of the law (first covenant) was also ratified by blood. The new covenant also ratified by blood. In all cases, something had to be killed to produce the needed blood (in the case of the covenant before the law and that of the law, it was animal which was a shadow of Christ). Scripture did not say someone had to die in ratifying the covenant before the law and covenant of the law but of the new covenant. Why? How each covenant was ratified differs. Blood is the major thing required in all and blood only comes by death, a shadow being fulfilled by Christ's death.
